My experience at IAD was same as explained above (June/06/2010) . .
I entered in AOS - EB3 - India.
During secondary session, I was asked lot of questions regarding my existing employer / earlier employer, also there were questions which were related to my 2006 employer too and tax filings of 2006 year too.
Overall with complete patience, managed to come into the country with approval after 4 hours.

Looks like NSC is sending EAD cards in a 'first filed first served ' sequence. I have been monitoring this with my friends circle, where EAD is issued in chronological order. About a few weeks ago, one of my friends received EAD for his July 24th filing, a week ago an Aug 6th filer received EAD card, Last week Aug 8th and 13th filers received EADs.
I filed on Aug 10, but no EAD yet for me. Anybody who filed before Aug 13, didn't receive EAD yet?
I filed my 485 on July 18 at NSC. The checks got cleared only last week at TSC. Looks like my 485 was tranferred from NSC to TSC. So, will I be having problem in getting my EAD, as my 485 is filed at TSC now, and EAD is at NSC.
Please respond your views.

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

Can someone please explain why copies of the passport (showing biographical data) are required? Which form asks for them - I did not find anything in I-485. That form only asks for a copy of the visa, if issued within the last year.

My wife is currently in the US and since my PD is current we need to file her I-485. We are trying to self file and would like to know what documents do we need to provide to prove that she successfully fullfilled her 2 year home residency requirement (HRR). She left the US in January 15, 2006 and came back on H4 in February 8, 2008.
The fact that she was granted H4 visa implies that she has fullfilled the 2 year HRR but our attorney said that she needs to prove that my wife did indeed fullfill this requirement.
Has anyone been in this position?
Please advise.

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

USCIS would keep family pack submitted at same time together. In your case it seems like your applications got separated. Taking an INFOPASS appointment may reveal this to IO and you may ask that they confirm that your son's application is together with the family pack.

What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husband�s citizenship would be approved before that and I might never have to leave the US.

Not a lawyer- but my guess is that the date of validity on your H1b (First H1) is the day you can start counting your 6 years. This is regardless of when you started working for your employer.
Example: Employer sponsored H1 for Mr.X on April 2nd 2005. H1 approved with validiity starting 1st oct 2005. Mr. X flew to the USA in december 2005. Started working 15th jan 2006. The 6 years are counted from 1st Oct 05.
Now one can recapture all the months that the employee was on vacation. But I am not sure if this is still an option.
The six year count starts from the day you entered the US first. If you take the above example, six year count starts from December 2005. Additionally, if there is gap from the time you entered and started working that period is considered out of status, that's all together different issue.

I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question
I'm applying for:
a) Permission to accept employment
b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

Hi,
I was working on L1 before and my h1 was approved in october but i joined on h1 only in december before the 60 day grace period?
Now i need to visit to india so
1) Will there be any problem to get stamped in india if i travel in April ?
2) Can i get stamped in Mexico or Canada? How many pay slips n other documents do i need ? What is the process of getting stamped in Mexico or Canada?
3) Which one is less risky (going to mexico or canada) ?
Please let me know ASAP. I appreciate your help on this.
