graduated with a MS in Computer science in may2007.
i applied to another university and got my sevis transferred to do my MBA there.
i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?
the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
please suggest.

yes, they're right. CPT is 12 months max full time and it is 12 months for every educational level.
1.Part-time CPT is 20 hours a week or less. If done during school year, must maintain full time status. It has no effect on OPT.
2.Full-time CPT is more than 20 hours a week. (25 hrs a week is full time). If you do more than 12 months of full-time CPT, you lose your OPT option

WASHINGTON - Senate Republicans and Democrats closed in on a last-minute compromise Thursday on legislation opening the way to legal status and eventual citizenship for many of the 11 million immigrants living in the United States illegally.
Sen. John McCain, R-Ariz., said he had been assured President Bush supports the measure, and would publicly say so later in the day.
As outlined, the measure would provide for enhanced border security, regulate the future flow of immigrants into the United States and offer legalized status to the millions of men, women and children in the country unlawfully.
"We've had a huge breakthrough" overnight, said Majority Leader Bill Frist, R-Tenn.

Sen. Harry Reid of Nevada, the Democratic leader, agreed, but cautioned that the agreement had not yet been sealed.
Even so, the presence of both leaders at a celebratory news conference underlined the expectation that the Senate could pass the most sweeping immigration bill in two decades, and act before leaving on a long vacation at the end of the week.
The developments marked a turnaround from Wednesday, when it appeared negotiations had faltered. The key sticking point involved the 11 million illegal immigrants in the country, and the struggle to provide them an opportunity to gain legal status without exposing lawmakers to the political charge that they were advocating amnesty for lawbreakers.
While final details were not available, in general, the compromise would require illegal immigrants who have been in the United States between two years and five years to return to their home country briefly, then re-enter as temporary workers. They could then begin a process of seeking citizenship.
Illegal immigrants here longer than five years would not be required to return home; those in the country less than two years would be required to leave without assurances of returning, and take their place in line with others seeking entry papers.

I got approved H1-B notice on 30th Dec 2008 from CSC. My previous expired H1-B date ends with 02/14/2009, but my current newly approved one starts with 02/26/2009. So there is a gap of 11 days between those. Currently I'm on job. Does it really means out-of-status?. Do I need to run February pay check with less hours and officially in vacation?.
Please advice me.

Hello everyone,
I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks
Lawyer is right. If you leave the country, you will be barred for 10 years from re-entry if you accumulated more than 1 year of "unlawful presence" ("out of status" is different and it is not a such a big deal to lose status as long as you do not accumulate unlawful presence). If you stay, you may be able to eventually get green card.
Can you provide more details regarding your timeline? Was I-485 filed? If you had pending I-485, "unlawful presence" counts from the date I-485 has been denied, not from the date H1 has expired.

I am in a weird situation. My wife has green card and my child is a US Citizen and she has a PIO Card (Indian Green Card). I was on H-4 till my wife got the green card - however, I have been told that the H-4 is invalid as soon as the primary applicant receives the green card. I have received my EAD Card and I have completed the FP. For whatever reason, the lawyer did not apply for I-131 till Oct 12, 2007. Now he says, it will take 90 days. What documents should I be carrying while traveling to India to travel on AP (if I ever get one). Any response will be highly appreciated. Please help.

A hypothetical, but important debate on worst case scenario in changing job using AC21

Assume changing jobs using AC21 has some risk, debate is what is that risk. I am not expecting response like pack up and leave back to home country as I already know that. I am interested serious debate from people who used AC21 and bought houses and simulated in American culture and have family reasons to stay in US.
Lets assume USCIS send some RFE and rejected 485 that new job was not same or similar. Now -
a) How many days I have to leave country ?
b) After the rejection of adjustment of status how many days I have to wrap up my current job or I must leave it same day when rejection letter received from USCIS ?
b) After those number of days can one acquire visitor's visa for up to six months to pack up stuff, house and family on the ground of rejection of adjustment of status?
c) Can one change status to some non immigrant visa such as new H-1B or F-1 by traveling back and reentering to USA ?
d) After the rejection of adjustment of status can one still port priority date in a new green card processing ?
f) I am also interested to hear feedback on what one can do to mitigate the risk of Ac21(I already know that use attorney's advise when changing job or donot change the job)

I got my passport renewed in 2005 as my old one was expiring. I had to send my original passport to the Consulate. They sent the new passport with the old one attached to it.

I am not very proud to announce this but, ICE stated a few days ago that the San Diego County Sheriff�s Department is the first law enforcement body to implement the Secure Communities program, under which every individual booked into the three largest jails in San Diego County will have biometric-fingerprints checked in a DHS system for an immigration record.
Secure Communities, which is administered by U.S. Immigration and Customs Enforcement (ICE), streamlines the process by which ICE determines if an individual in the prison system is a removable criminal alien. Under the program, every individual booked into the three largest jails in San Diego County has their biometrics-fingerprints-checked in the U.S. Department of Homeland Security's (DHS) biometric system for any immigration record. Prior to the advent of Secure Communities, as part of the standard booking process, these fingerprints were only checked for criminal history information in the U.S. Department of Justice's (DOJ) biometric system.
If any fingerprints match those of someone in DHS's biometric system, the new automated process notifies ICE and the San Diego intake site submitting the fingerprints. ICE evaluates each case to determine the individual's immigration status and takes appropriate enforcement action after offenders complete their prison terms.
Illegal Immigrants will now be more reluctant to get in touch with law enforcement, thus expect more abuse towards illegals.

I am now thinking of joining an Indian based company and work for same company in US. With this I can always have a base in India and can think of relocate back if need arises. Can anyone tell me the recruiting procedure for some major companies for an applicant like me ? or How to get a recruited to Indian company while being in US..??
My area of expertise is ASP.net 3.5, AJAX, SQL Server., C#. I hold BE in CS and later completed MS in US. I have been working in US from past 5 years after completing MS.
Greatly appreciate any inputs on this�
Interesting queston. Now if you want to look for such a job, you need not really restrict to Indian based companies like TCS , INFY etc... A lot of MNCs have moved IT to India and other countries - A lot of American companies do have offshore development centers in other countries - right from Microsoft, Dell, HP, AMD .................the list will go on and on - a lot of employees relocated to their home countries and some also travel back and forth on business trips ...
Now, if you think that it is in your best intrests to join companies like Infosys, TCS etc.. a lot of those jobs are filled via referrals through existing employees or once in a while they have reqruiting drive across the country

VFS site mentions that whole of Andhra falls under HYD jurisdiction. Probably it means that applicant if he/she going for visa first time, may not take appointment at other consulates.
Also, SF Indian consulate clearly mentions that they do not provide any services to short term visitors that includes visitors....
